Automated decision-making in public administration

The aim of the paper is to examine the issue of automated decision-making, i.e. decisions made by artificial intelligence. The use of automated decision-making is on the rise not only within private sectors, but also within the public sector. In today’s world, people increasingly expect speedy decision-making, in particular in areas of public administration where to the so-called mass decisions are made pertaining to, i.a., taxation, social benefits, fees, permits, licences. Despite the fact that artificial intelligence has long been used in many areas of public administration in Poland, the automated, algorithmic decision-making process has not been regulated at the national level. The existent regulations pertain only to the serving and signing of documents. In Poland, there is a severe lack of comprehensive rules regulating automated-decision making, and at the same time, safeguarding administrative due process. The paper is based on analysis of normative acts and practice, supported by the study of secondary sources.
