Dokonane w 2016 r. zmiany w ustawie o niektórych formach popierania budownictwa mieszkaniowego umożliwiły realizację, z wykorzystaniem metod właściwych dla działalności bankowej, kolejnego rządowego programu mieszkaniowego o wyraźnie wyznaczonych granicach podmiotowych i przedmiotowych. Jest to program wspierania rozwoju społecznego budownictwa czynszowego, w tym jego istotnej części dedykowanej osobom o umiarkowanych dochodach, które nie są zainteresowane zaspokojeniem swoich potrzeb mieszkaniowych w drodze nabycia prawa własności lokali mieszkalnych. Celem artykułu jest analiza i ocena regulacji prawnych dotyczących mechanizmu zwrotnego finansowania tzw. przedsięwzięć inwestycyjno-budowlanych realizowanych przez społeczne inicjatywy mieszkaniowe, spółdzielnie mieszkaniowe oraz spółki gminne. W prawnej konstrukcji mechanizmu zwrotnego finansowania, stosowana jest forma kredytu udzielanego na warunkach preferencyjnych odnoszących się przede wszystkim do zasad jego oprocentowania oraz okresu spłaty. Efekty ilościowe i wartościowe osiągnięte w połowie 10-letniego okresu realizacji tego programu potwierdzają, że interwencja prawodawcy w konstrukcję mechanizmu zwrotnego finansowania była uzasadniona i spowodowała wzrost zainteresowania inwestorów. Utrzymanie tej tendencji wymaga jednak dalszego doskonalenia regulacji prawnych, które stanowią ważny element Narodowego Programu Mieszkaniowego przyjętego w 2016 r.
The amendments made in 2016 regarding the law on certain forms of supporting housing construction made it possible to implement another government housing program with clearly defined subjective and objective boundaries using methods appropriate for banking activities. It is a program of supporting the development of social rental housing, its significant part is dedicated to people with moderate incomes who are not interested in satisfying their housing needs by acquiring the ownership right to housing units. The aim of the article is to analyze and to evaluate the legal regulations regarding the repayable financing mechanism of the so-called investment and construction projects carried out by social housing initiatives, housing associations and municipal companies. The legal structure of the repayable financing mechanism, uses the form of a loan granted on preferential terms, relating primarily to the principles of its interest rate and the repayment period. The quantitative and quality effects achieved in the middle of the 10-year implementation period of this program confirm that the legislator's intervention in the construction of the repayable financing mechanism was justified and resulted in an increase in investors' interest. Maintaining this trend requires, however, further improvement of legal regulations, which constitute an important element of the National Housing Program adopted in 2016.
